The head-protection standard is one page long, names three consensus standards and contains no expiry date anywhere. Almost everything contractors argue about on this subject is manufacturer guidance, not regulation — and knowing which is which matters when a GC quotes a rule at you.
When it is required
1926.100(a), in full: “Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.”
Three triggers — impact, falling or flying objects, electrical shock and burns — and the qualifier is possible danger, not certain danger. That is a low bar, and it is why blanket hard-hat rules on active construction sites are defensible. It is also why an area genuinely free of all three, such as a fully enclosed site office, is not covered by this sentence.

The three editions OSHA accepts
1926.100(b)(1) requires head protection meeting the specifications in any of three consensus standards, all incorporated by reference in 1926.6:

And a performance escape hatch at 1926.100(b)(3): OSHA will deem any head protection device the employer demonstrates is at least as effective as a device built to one of those standards to be in compliance. That clause is what lets newer designs — including many climbing-style helmets with chin straps — onto a site, provided the employer can make the demonstration.
Type and class markings live inside the ANSI standard, not in the CFR. Read the label in the shell: it tells you the edition, the type and the electrical class the hat was certified to.
The electrical clause
1926.100(b)(2): the employer must ensure that head protection provided for each employee exposed to high-voltage electric shock and burns also meets the specifications in Section 9.7, “Electrical Insulation”, of one of the three standards above.
This is the clause that decides whether a vented helmet is acceptable. Vents cool the wearer and they are also holes; a helmet certified for electrical insulation is not vented. On a site with any high-voltage exposure the ventilated comfort option is off the table for the exposed employees — which is a heat-management problem to solve elsewhere, in the heat illness prevention plan, not by picking a helmet that fails the clause.

The truth about expiry dates
There is no expiry date in the OSHA standard. 1926.100 sets a performance requirement and names consensus standards; it does not say five years, four years or any other number. The service-life figures circulating on jobsites come from manufacturers, and they differ by product.
Which means the rule that actually governs is the manufacturer’s instructions for the hat in your hand plus the general PPE duty to keep equipment in a safe, sanitary and reliable condition. Two dates are usually moulded into the shell: a date of manufacture, and sometimes a suspension date. Use them against the manufacturer’s stated service life, not against a number somebody heard.
Retire a shell immediately after any impact, and whenever inspection shows cracking, chalking, brittleness, a deformed or torn suspension, or damage from solvents or heat. Add the check to the weekly site walk.
And the hat is the employer’s cost. Head protection is not one of the two narrow exceptions to 1910.132(h) — those cover only non-specialty safety-toe footwear and non-specialty prescription safety eyewear, and only when they may be worn off site. See PPE requirements for construction.
